The family of the 16-year-old boy critically injured when a tree fell on him last week in Jackson Square plans to sue the City of New Orleans.
The family's attorney says the lawsuit will be filed early next week.
The boy and his family were tourists from the San Antonio area when the oak tree split in half and fell on top of him.
The teen is still in intensive care with a severe brain injury.
Mayor LaToya Cantrell's communications team scheduled a press conference on Monday, but it was abruptly canceled 15 minutes later.
